Section 88 CrPC Attachment of Property of Person Absconding

Section 88 CrPC as per Law, the property of person absconding is attached. The Court issuing a proclamation under Section 87 may at any time order the attachment of any property, movable or immovable or both, belonging to the proclaimed person.

The Supreme Court of Pakistan has held that the power under Section 88 CrPC of the Code of Criminal Procedure to release a person on accepting bond, cannot be claimed as a matter of right by the accused. It is a discretionary power given to the court to facilitate appearance of the person.

That discretionary power given to the Court under Section 88 of CrPC is for the purpose and object of ensuring appearance of such person in that Court or to any other Court into which the case may be transferred for trial.
