Rights of Minors to Property Under Guardianship Act

As per Lawkidunya, The Guardianship and Wards Act, 1890 is a legislation in Pakistan that governs the rights and welfare of minors. Here are some of the key rights of minors to property under the Act:

Rights to Property

1. Right to Own Property: Minors have the right to own property, including immovable and movable property.
2. Right to Inherit Property: Minors have the right to inherit property from their parents or other relatives.
3. Right to Manage Property: Minors have the right to manage their property, subject to the supervision of the guardian.

Protection of Minor’s Property

1. Protection from Alienation: The property of a minor cannot be alienated or transferred without the permission of the court.
2. Protection from Mortgage: The property of a minor cannot be mortgaged without the permission of the court.
3. Protection from Lease: The property of a minor cannot be leased for a period exceeding five years without the permission of the court.

Duties of Guardians

1. Duty to Protect Property: Guardians have a duty to protect the property of the minor and ensure that it is not wasted or mismanaged.
2. Duty to Manage Property: Guardians have a duty to manage the property of the minor, subject to the provisions of the Act.
3. Duty to Account for Property: Guardians have a duty to account for the property of the minor and provide regular reports to the court.

Court Intervention

1. Power to Appoint Receiver: The court has the power to appoint a receiver to manage the property of the minor if the guardian is unable or unwilling to do so.
2. Power to Remove Guardian: The court has the power to remove a guardian if they are not acting in the best interest of the minor or are mismanaging the minor’s property.
3. Power to Give Directions: The court has the power to give directions to the guardian on the management of the minor’s property.
