Application For Contempt of Court Petition Under Section 22-A, 22-B CrPC

Contempt of Court, often referred to simply as “contempt”, is the offense of being disobedient to or discourteous toward a court of law and its officers in the form of behavior that opposes or defies the authority, justice and dignity of the court.

Petitioner

Versus

1. S.H.O. Police Station Samanabad Lahore.
Respondent

Petition Under Section 22-A, 22-B CrPC read with section 25 Cr.p.c. for Compliance with the order dt:11-07-2017 and under section 155-C of Police Order 2002 for Initiation of Criminal Proceeding against the Respondent that he has Violated the order of the Honourable Court dt: 05-05.2017.

Respectfully Sheweth,

1. That abridgely the facts giving rise in the instant petition are that the petitioner is a law abiding citizen of Pakistan and has a very good antecedent in his credit.

2. That being aggrieved the petitioner moved a Writ Petition Under Section 22-A, 22-B CrPC before this honorable court, and honorable court pleased to announce the order 11-07-2017 to the respondent for the registration of a criminal case against the accused persons. Order of this honorable court is annexed with this contempt petition.

3. That the petitioner again approached the respondent with the order of this honorable court, but the respondent again totally refused to accept the order of this honorable court and asked the petitioner that he can not accept this order, because these orders are routine matter orders.

4. That the respondent has totally refused to accept the order of this honorable court, and in this way he did contempt of court. And the act of the respondent is against the law and the basic values and principles of justice, while on the other hand it is crystal clear under the 154 cr. p. c that if the in charge of a police station received any information of a cognizable offence writing or oral, and if a cognizable offence made out he shell proceed further, and he has no power to refuse for registration of a criminal case against the accused person.

5. That the order of this honorable court is also crystal clear and honorable court also relying upon the case law PLD. 2007 S.C.539 and 2008 YLR 2406 Lahore.

6. That the act of respondent is very funny towards the order of this honorable court, and to strict action would be taken against the respondent is necessary for the interest of justice.

PRAYER
Under these circumstances its most humbly and respectfully prayed that the proceedings under contempt of the court act may kindly be initiated against the respondent and be ordered to produce the F.I.R in the honorable court as compliance of the order dt 11-07-2017, and dealt him strictly in accordance with law. Any other relief which the honorable court deems fit may also be awarded.
